Terms of Service

These Terms of Service ("Terms") govern your use of the website and web application 3DMindNet available at https://3dmindnet.com (the "Service"), published by FIBATEC. By creating an account or using the Service, you accept these Terms.

3DMindNet lets you organize ideas and notes as an interactive 3D knowledge graph: spaces, projects, groups, notes, links, file attachments, collaboration with other users, public read-only embed links, and an optional Notion integration to import, export and sync pages and databases. Public examples can be explored without an account.

The Service is in early access. Features may change, be added or removed, and the Service may occasionally be unavailable.

3. Price

The Service is currently free. We may introduce paid plans in the future. We will tell you in advance, and paid features will only apply if you choose to subscribe; separate pricing terms will apply then.

4. Account

You sign in with a Google account. You must provide accurate information, keep access to your Google account secure, and be at least 15 years old. You are responsible for activity under your account. Tell us at contact@3dmindnet.com if you suspect unauthorized use.

5. Your content

You keep all rights to the content you create, upload or import ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process and display Your Content only as needed to operate the Service for you (including showing it to the members you invite and to anyone with a public embed link you enable).

You are responsible for Your Content and confirm you have the rights to it. You must not upload or share content that is illegal, infringing, defamatory, hateful, malicious (malware) or that violates others' privacy.

We recommend keeping your own copy of important content. We are not responsible for loss of content, within the limits of applicable law.

6. Sharing and collaboration

When you invite members to a space, they can view or edit its content according to the role you give them. When you enable a public embed link, anyone with the link can view that project's graph without signing in. You can disable or rotate the link at any time.

7. Third-party services

The Notion integration and Sign in with Google are provided by third parties (Notion Labs, Google) under their own terms. 3DMindNet only accesses the Notion pages and databases you share with the integration and acts on them at your request (import, export, sync, inserting an embed). We are not responsible for third-party services, their availability, or changes to their APIs.

8. Acceptable use

You agree not to: break or bypass security or access controls; overload, scrape or disrupt the Service; access other users' data without permission; use the Service for illegal purposes or spam; resell the Service without our written agreement.

9. Intellectual property

The Service, its software, design, logo and the 3DMindNet name are protected and belong to FIBATEC or its licensors. Except for Your Content, nothing in these Terms grants you rights to them.

10. Availability and liability

The Service is provided "as is" and "as available", especially during early access. We do our best to keep it running and secure but do not guarantee it will be uninterrupted or error-free. To the extent permitted by law, we are not liable for indirect damages or loss of data, profits or business. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer.

11. Suspension and termination

You can stop using the Service at any time and ask us to delete your account by emailing contact@3dmindnet.com. We may suspend or close an account that seriously breaches these Terms, after notice when possible. We may also discontinue the Service with reasonable notice.

13. Changes to these Terms

We may update these Terms. We will notify you of significant changes in advance by email or in the app. Continuing to use the Service afterwards means you accept the new Terms.

14. Governing law and disputes

These Terms are governed by French law. If you are a consumer, you also keep the protection of the mandatory rules of your country of residence. Please contact us first at contact@3dmindnet.com to find an amicable solution. If you are a consumer, you may also refer the dispute to a consumer mediator or any other alternative dispute resolution method. Failing an amicable solution, disputes go to the competent French courts, without prejudice to consumers' right to bring proceedings in their country of residence.
